California Criminal Records in San Diego
Beyond the local court and sheriff, San Diego County residents can tap into state-level criminal record resources. The California DOJ is the main one. It keeps the statewide criminal history repository. You can request your own RAP sheet through Live Scan fingerprinting for $25. San Diego County has many Live Scan locations. Use the DOJ locator tool to find one near you. The process is quick at the Live Scan site itself, usually about 15 minutes. Results take 48 to 72 hours if no record is found, longer if one exists.
Background check status can be tracked at applicantstatus.doj.ca.gov. You need your ATI number and date of birth. The sex offender registry at meganslaw.ca.gov is also available. San Diego is one of the larger urban areas in the state, so searches by neighborhood or zip code tend to return a good number of results.
Clearing Records in San Diego County
San Diego County residents with criminal records can use California's record relief laws. Penal Code Section 1203.4 allows people who completed probation to petition for case dismissal. The petition goes to the same courthouse that handled the original case. Success rates vary depending on the charge and the judge, but many routine cases get approved without a hearing. The dismissed status shows on your RAP sheet and helps with employment and housing applications.
Arrest record sealing under Penal Code Section 851.87 is another option when no conviction resulted from the arrest. This law, which took effect in 2018, removed the old requirement to prove factual innocence. Now, as long as no conviction came from the arrest, you can petition to seal the record. Proposition 47 and Proposition 64 relief are also widely used in San Diego County. The San Diego Volunteer Lawyer Program and Legal Aid Society of San Diego offer help with these petitions for people who qualify financially.
